Application for Exempt Certificate of Authority
The following cemeteries may qualify for an Exempt Certificate of Authority, pursuant to La. R.S. 8:78:
- Fraternal Cemeteries, Municipal Cemeteries, Community Cemeteries, State Cemeteries, Federal Cemeteries and Religious Cemeteries that do not sell cemetery spaces, sell the right of use or interment in any cemetery space, or charge a maintenance fee per cemetery space for an amount in excess of three hundred dollars ;
- Community Cemeteries owned and operated by non- profit corporations in existence prior to January 1, 2007, whose officers and directors service on a voluntary basis without compensation for their services; or
- Columbarium facilities owned and operated by churches for the interment of human remains.

NOTE: As provided for by La. R.S. 8:78, any cemetery authority or person holding an exempt certificate of authority, including Family Burial Grounds, shall apply for a renewal of the certificate by submitting to the board such information as the board deems necessary to determine if the cemetery authority or person continues to meet the qualifications for exemptions. Renewals are sent in three-year intervals and must be accompanied by a renewal fee of fifty dollars to maintain the exemption previously granted. The next renewal cycle for holders of an exempt certificate of authority is in 2025 and will be due no later than April 1, 2025.

Conversion Questionnaire
This questionnaire is to determine if a change in ownership or control has occurred when a licensed cemetery authority converts from a corporation to a limited liability company (LLC). If it is determined that a change in ownership or control has occurred, the cemetery authority will need to complete and submit a new Application for Certificate of Authority as provided for by R.S. 8:76.
NOTICE:
All Applications for Certificates of Authority, Exempt Certificates of Authority, Family Burial Grounds, Cemetery Sales and Management Organizations and Abandoned Cemetery Sales and Management Licenses must be approved by the full Louisiana Cemetery Board (“Board”) at a regularly scheduled meeting.
The Board generally meets twice per year, but may meet on additional dates. Meeting dates are posted on the News & Links page of this website. Applications for License can only be presented to the Board for approval once the Application for License and ALL OF THE REQUIRED DOCUMENTATION is received and reviewed by the staff for completeness and accuracy. Therefore, Applications or License along with ALL OF THE REQUIRED DOCUMENTATION must be submitted for review by staff no later than 30 days prior to a scheduled meeting. Only those Applications for License that have been reviewed and determined to be complete and accurate by staff will be placed on a Board meeting Agenda for consideration.
